Mackay man denies raping his daughter

A MACKAY man has emphatically denied raping his daughter numerous times over several years following the breakdown of his marriage with the girl's mother.

The man, 41, who cannot be named in order to protect his daughter's identity, pleaded not guilty on Tuesday in the Brisbane District Court to rape and maintaining a relationship with a child.

The court heard the offences took place at various times when the family lived at Howard, near Hervey Bay and Bundaberg, between 2002 and 2008.

The girl was aged between four and 10 years old at the time.


Crown prosecutor Sarah Dennis told the court the girl will describe living with her father and other siblings after their parents separated.

She said the girl will say her father raped her every night for a number of years.

"The girl will describe being in her father's bed when they lived at Howard and you will hear her say he put his penis inside her and raped her," she said.

"But you will also hear her say this was not the only time he raped her.

"She will tell you that her father raped her every night, or if not every night, then every second night, for a number of years."

"You will hear the girl say she was too scared to tell anyone at first because of the threat of physical punishment."

Defence barrister Kim Bryson told the jury to pay particular attention to the girl's police interview conducted in May, 2012.

"The evidence in this trial comes solely from the girl," she said.

"I ask you scrutinise the girl's evidence with great care and specifically focus on the numerous inconsistencies and lies she tells throughout her interview with police."

The trial before Judge David Reid continues.
