Flood victim spared jail for fraud

A GRANTHAM flood victim charged with dishonesty offences has been spared time in jail due to the hardship it would cause his 11-year-old son.

At Ipswich District Court yesterday, Daniel David McGuire pleaded guilty to one count of fraud and two counts of unlawfully possessing a motor vehicle.

The 57-year-old fraudulently obtained $7000 from his then-employer Black Duck Park Proprietary Limited between April 26, 2010, and June 30, 2010.

A month later he was found in possession of a stolen 2003 Toyota Hilux, worth $44,669 and a stolen motorbike.

Judge William Everson noted the rural firefighter had suffered an "unimaginably tragic event" during the Lockyer Valley flood disaster in 2011.

McGuire's wife and two children were all killed when a torrent of water ripped through their home town.

He and his son Zac were the only ones to survive.

Judge Everson said a psychological report showed McGuire's son suffered post-traumatic stress disorder and that "stability of home life" was essential to his progress.

Judge Everson said the hardship caused to an offender's children would not normally be taken into account, however this was an exception.

McGuire was sentenced to two years' jail and released on immediate parole.
