Family hopes inquest gives answers to workplace death

ON HIS second day at a job Simon James Poxon was killed.

A coronial inquest later this year aims to find out the circumstances around his death.

A pre-inquest hearing in Brisbane on Monday heard on February 26, 2013 Mr Poxon and a co-worker at Sherrin Rentals picked up a knuckle boom lift from Esk and drove it back to their Torrington depot.

There, the two were refuelling the knuckle boom lift when another Sherrin Rentals employee reversed a nearby tower truck into Mr Poxon - trapping him between the machines.

An ambulance transported Mr Poxon to hospital but he died of his injuries. Numerous staff saw the incident - many of whom will be called to the inquest.

Although a police investigation into the incident found insufficient evidence to prosecute the driver, Sherrin Rentals employee Jameson Boon, Workplace Health and Safety Queensland launched a prosecution against him, but not against the company.

In June 2015 Boon pleaded guilty to failing to comply with health and safety duties and was placed on a $5000 bond.

Megan Jarvis, counsel assisting the coroner, said Mr Poxon's family had expressed concerns about the investigations and the wider system response to his death.

"Simon's wife, Marie, finds this particularly difficult as she remembers Simon as someone who took workplace safety very seriously during the running of his own business for many years, not just for himself but for those he employed, his clients and the public," she said.

Mr Poxon, a qualified carpenter and builder, had previously run a house removal, restumping and levelling business.

Ms Jarvis said while the inquest could not apportion blame it could help the family and public understand the circumstances leading up to Mr Poxon's death and try to stop other people dying in similar ways.

The inquest will be held at the Toowoomba court house January 18-22, 2016.
