Man granted bail after shooting another to ‘defend family’

A MACKAY man who allegedly shot another man to protect his family has been granted bail on the condition that he lives at Rockhampton.

Supreme Court Justice David Boddice said Rural View man Jamie Lee Kearines's case was "unusual".

It is alleged that a stranger had wondered into Mr Kearines's front yard unannounced and started banging and screaming before Mr Kearines, 37, shot the man in the elbow with a rifle.

The father of two has been charged with acts intended to cause grievous bodily harm, unlawful possession of a rifle and possessing dangerous drugs and drug utensils.

On Friday Mr Kearines applied to Brisbane Supreme Court to be released on bail.

The Crown opposed granting him bail amid concerns Mr Kearines would re-offend if released from jail or flee because of the seriousness of the charges against him.

But Justice Boddice said he was satisfied strict conditions could be imposed.

He said the shooting was a serious offence and that Mr Kearines was a committed family man who had ties with the community.

"The most serious of these alleged offences appear to have arisen in the context of the applicant choosing to defend his family in the family home from an aggressive and intoxicated stranger who appeared at their door," he said.

Justice Boddice also said Mr Kearines had limited criminal history and had mostly led an "unblemished life".

He granted Mr Kearines bail with conditions that he live at Rockhampton, abide by a curfew and report to police.
