Domestic violence puts man in jail for Christmas and NYE

ONE Mackay man will spend Christmas in jail after he breached a domestic violence order for the fifth time in two years.

The 42-year-old had been drinking with his partner and when the pair returned home they got into an argument.

He called her degrading names and when she told him to leave he didn't.

Instead he stayed in the yard the whole night, the Mackay Magistrates Court was told.

Although violence wasn't involved in this latest offending, Magistrate Damien Dwyer said he still considered it serious offending.

Mr Dwyer said no woman should be called names like what he had yelled at his partner.

"It's simply not on," Mr Dwyer said.

The man, who appeared in court from the dock, had breached four domestic violence orders since September 2013.

Mr Dwyer said the man had been placed on probation in 2013 for similar behaviour.

And on September 1 last year, he'd been jailed for domestic violence offending.

His criminal history included being a public nuisance, drug matters, assaulting police and wilful damage, the court was told.

Mr Dwyer said the courts had given the man every opportunity to rehabilitate himself; there was no other option this time but a sentence of imprisonment.

The man, who pleaded guilty to breaching a DVO, had been in custody for four days after he was arrested on December 11.

He was jailed for six months to be released on parole on February 10.

"Enough is enough," Mr Dwyer said. He told the man if he wanted to keep behaving like this he would go to jail for longer and longer periods of time.
