Text threats after ex-partner admits to contracting STD

A MAN who sent text messages threatening to kill his ex-partner claimed she had told him she had contracted a sexually transmitted disease when seeing another man, Toowoomba Magistrates Court heard.

Donald Paul Gallaway had sent 182 text messages to his former partner in September, the court heard.

Police prosecutor Alistair Windsor told the court three of those messages included threats to tie her to and drag her behind a vehicle, burning her to death and telling her he would kill her if she didn't kill herself first.

Many of the other text messages were of an abusive nature and all were in breach of a domestic violence order, Senior Constable Windsor said.

When spoken to by police on September 23, the 39-year-old had become verbally abusive toward police and had struggled when arrested, the court heard.

Gallaway pleaded guilty to using a carriage service to menace, harass or cause offence, obstructing police and breaching a domestic violence order.

His solicitor Nathan Bouchier told the court his client had been in a relationship with the woman for 15 years and in the two years since separation the couple had an on/off relationship.

When his client found out the woman had been seeing someone else and had contracted a sexual transmitted disease the couple had split but had argued.

His client had been placed on medication after suffering a mental breakdown after the couple initially separated but he had stopped taking the medication some weeks prior to the incident, Mr Bouchier said.

His client was now on different medication, had moved to the Gold Coast and was seeing a clinical psychologist, he told the court.

Magistrate Damian Carroll noted Gallaway had no criminal history and fined him $2000.
